Basis for the processing of personal data

 

Based on the provisions of articles 3, section I, 15, 40 and 43, section III of the Federal Law on Protection of Personal Data Held by Private Parties and its correlatives 23 and 26 of the Regulation, 5, section XVI of the Regulation Interior of the Ministry of Economy, and

 

 

CONSIDERING

That article 16 of the Political Constitution of the United Mexican States recognizes that everyone has the right to the protection of their personal data, access, rectification and cancellation thereof, as well as to express their opposition in the terms established by law. , which will establish the assumptions of exception to the principles that govern data processing;

That the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the Law) and its Regulations, constitute the general framework that establishes the rules, requirements, conditions and minimum obligations to guarantee an adequate treatment of information data by individuals, without prejudice to the provisions of the sectoral or specific regulations applicable to the processing of personal data by individuals;

That the privacy notice is the document through which the person in charge informs the owner about the terms under which their personal data will be processed, highlighting the identity of the natural or legal person who decides to carry it out; the purposes or actions that motivate the obtaining, use and custody of personal information; the third parties to whom the personal data will be transferred; the mechanisms so that the holder can exercise the rights linked to the protection of personal data (in particular, the ARCO rights), among other issues;

That the privacy notice allows the owner to decide freely and informed about the processing of their personal data;

That the modality and moment in which the privacy notice will be made available to the owner will depend on the specific circumstances in which the personal data is collected, provided for in the Law and the Regulations, and linked to the means used to obtain personal data and the fact that they are obtained personally, directly or indirectly from their owner;

That it is in the interest of the Ministry of Economy, in its capacity as regulatory authority, to issue the corresponding guidelines to determine the content and scope of the privacy notice, in collaboration with the Federal Institute of Access to Information and Data Protection, and that it is interest of the Federal Institute of Access to Information and Data Protection, in its capacity as guarantor authority of the right to protection of personal data, monitor and ensure due observance of the principles that govern this right, to which it refers the Law and its Regulations; as well as establishing a series of minimum, necessary and uniform rules regarding the preparation, content, use, modalities and dissemination of the privacy notice.

Some terms that we want to inform you.

 

Without prejudice to the definitions provided in articles 3 of the Federal Law on Protection of Personal Data Held by Private Parties and 2 of its Regulations, for the purposes of these Guidelines, the following shall be understood as:

 

e-commerce : Also known as electronic commerce, it is the exchange of products or services using computer networks, specifically the Internet.

Cookies: Data file that is stored on the hard drive of a user's computer equipment or electronic communications device when browsing a specific internet site, which allows the exchange of status information between said site and the user's browser. Status information may reveal means of session identification, authentication or user preferences, as well as any data stored by the browser regarding the website;

 

Guidelines: Privacy Notice Guidelines;

Obtain personal data directly from its owner: Act in which the owner himself provides personal data by some means that allows direct delivery to the person in charge, including electronic, optical, sound, visual means or any other technology, such as postal mail, internet or by telephone, among others;

 

Obtain personal data indirectly: Act in which the person in charge obtains personal data without the owner having provided it personally or directly, such as through a public access source or a transfer;

 

Make the privacy notice available directly: Act in which the privacy notice is made known to the holder by some means that allows its direct delivery, including electronic, optical, sound, visual means or any other technology, such as postal mail, internet or telephone, among others;

Web beacons: Visible or hidden image inserted into a website or email, used to monitor user behavior in these media. Through these you can obtain information such as the source IP address, browser used, operating system, time the page was accessed, and in the case of email, the association of the above data with the recipient.

 

Where can I exercise my ARCO rights?

Response times to your request

 

To respond to your request, Martha Carolina Garza Gallardo has a maximum period of 20 business days, which can be extended once if there is just cause.

If the request is appropriate, the holder may make his ARCO right effective within 15 business days following the date of response. This period may be extended only once for just cause.

 

In the event that Martha Carolina Garza Gallardo does not respond or the owner is not satisfied with her response, or in the event that she considers that her right to the protection of personal data has been violated, she may submit a Data Protection Request to the IFAI.

Transfer of personal data.
